Birketts LLP A growing firm with a growing reputation

Married couples

As soon as you said “I do”  at your wedding, you have signed up to a wide range of duties and responsibilities during your marriage, as well as possible financial claims against each other if your marriage fails.

You may wish to separate from your spouse temporarily or more permanently.  Alternatively, you may want to end your marriage.  A divorce ending with a decree absolute is the legal process which brings about the formal and legal end to your relationship.

The status of your marriage has no impact on the way that arrangements for any children should be resolved should you not be able to reach an agreement.  Here the law is neutral.

Ending the marriage does not automatically bring an end to the financial claims which spouses can make against each other.  Unless you obtain a final financial court order with the divorce, you could face a claim from your former partner many years into the future.
