Our telecommunications law firm advises landowners, developers and investors on the full range of telecoms issues affecting land and buildings.
As experienced telecommunications lawyers and property dispute solicitors, we provide clear and commercially focused advice on disputes, lease negotiations and strategic matters under the Electronic Communications Code. Acting exclusively for landowners, we support you in protecting your property interests, managing operator relationships and securing long term value from your assets.
The Electronic Communications Code is the key legal framework governing telecoms rights over land. It has significantly reshaped how sites are valued, how agreements are renewed and how operators exercise rights of access and upgrade.
Our telecoms solicitors provide strategic advice on navigating the Code, including resisting or negotiating operator rights, managing renewals and protecting redevelopment opportunities. We stay at the forefront of legislative developments, including the impact of the Product Security and Telecommunications Infrastructure Act 2022 and evolving Tribunal decisions.
How we can help
Our telecoms lawyers advise landowners in a fast evolving market shaped by the continued rollout of 5G and full fibre networks. Increased demand for digital infrastructure has led to a rise in access requests, valuation disputes and redevelopment constraints.
We combine legal expertise with a strong understanding of how telecoms arrangements affect land value and development potential. Our approach is practical and commercially focused. We seek to resolve matters through negotiation where possible, but we are equally experienced in formal property litigation and Tribunal proceedings where required.
We also work closely with our real estate teams to ensure telecoms issues are considered alongside wider asset management strategies, enabling you to make informed decisions about your land and investments.
Our telecoms legal services include:
Mast evictions and vacant possession strategies
Advising on termination rights and redevelopment grounds to remove telecoms equipment efficiently.

Our Experience
We are recognised telecommunications lawyers with significant experience acting for landowners on complex telecommunications disputes, including high value redevelopment schemes and urgent possession strategies.
Central London developer
For the last couple of years, we have advised an asset management client on the eviction strategy for removing multiple phone masts and broadband cabling from a major City centre office building which is scheduled for redevelopment. The work involved advising on the eviction process and preparing and serving the necessary termination notices. The matter required co-ordination with the client’s agents and real estate lawyers to ensure that the eviction was timed to coincide with the vacant possession strategy for the remainder of the building. The building will be a new landmark development in Central London. With such long notice periods for the eviction of phone masts, it has required careful planning throughout.
Local authority client
We are advising a local authority client on the urgent eviction of a phone mast from a residential housing block where building safety works need to be carried out. The external cladding is being replaced and the roof stripped off and replaced, which cannot proceed without the phone mast first being removed. Our advice involves outlining the eviction process, serving the necessary notices and taking the phone company to Court for a termination order under the Landlord and Tenant Act 1954. Given the urgency of the project, a summary judgement application has been applied for on an expedited basis.
Residential housing developer clients
We act for several major housebuilding clients, managing the legal work for the portfolio of phone masts on their buildings as well as dealing with the various access requests and wayleave applications affecting their properties. We regularly advise on the options available to landowners in opposing new telecom installations, including objecting to planning applications and opposing Tribunal applications. Our advice also includes managing the rollout of “fibre to the premises” connections in large residential developments and granting leases, dealing with upgrades and site sharing arrangements and acting on rent reviews.
Birketts’ IT and telecoms team has good knowledge of technology agreements and English law. We worked with them on a complex technology contract in the financial services area, and they were able to handle the legal aspects professionally. For international clients who need English law expertise, the team is a reasonable choice. They know the subject matter and approach the work in an organized manner. This is in addition to the very reasonable pricing that the Birketts team brings to each project.
