Independent Administrators
An independent administrator is typically appointed by the court to manage the estate where there is no valid Will, the named executors are unwilling or unable to act, or disputes arise. This can be an individual or a trust corporation.
Birketts can act as an independent administrator either:
- Through the personal appointment of partners, or
- Through the Birketts Trust Corporation (BTC), where the directors are all partners in our Private Client Team.
This structure allows us to assign the most appropriate individual or team to your case, taking into account your location, the complexity of the estate, and your preferences.

Our Experience
Lorna Spear was appointed as independent administrator by the High Court in the case of Lane v Lane [2024] EWHC 275 (Ch).
Birketts took over the administration of an estate of a deceased landed estate from a firm that were being investigated by the SRA for malpractice.
Bernadette Baker was recently appointed as independent administrator by the High Court in relation to an intestate estate.
