Terms of building safety contract published
14 July 2022
As part of the package of measures aimed at preventing another Grenfell tragedy, the Government demanded that large developers sign a pledge to remediate fire safety risk in buildings in England over 11m tall. The pledge will become a binding contract, and the draft terms of the contract have now been published.
48 developers have signed the pledge, which will cover buildings which they developed or refurbished since 5 April 1992 (except those in which they acted solely as a contractor). The contract is expected to be finalised in August.
The Building Safety Act includes a large set of provisions including the mandatory registration of building inspectors, a new building safety regulator, the right of the Government to prohibit companies or persons from acting as developers, and an extension of the limitation period for making claims from 12 to 30 years historically, and from 12 to 15 years from now on.
The Act, the first parts of which are already in force, will impact on the whole property sector.
