Rachel joined Birketts in October 2021 as an Associate in the Contentious Trusts and Probate Team in the Chelmsford office. Rachel qualified as a solicitor in March 2018 and has worked within in the field of Contentious Trust and Probate for four years.
Rachel specialises in contentious trusts and probate matters and can offer advice and assistance in the following areas:
- Claims for provision from an estate under the Inheritance (Provision for Family and Dependants) Act 1975.
- Claims arising from allegations of undue influence, lack of testamentary capacity and/or want of knowledge and approval in connection with the preparation and execution of a Will.
- Disputes between beneficiaries and executors as to the administration of an estate, and disputes between trustees and beneficiaries as to the administration of trusts.
- Proceedings in the Court of Protection .
Rachel has experience settling matters without court proceedings, but also dealing with cases which go to trial and appeal. Rachel dealt with the notable cases of Clitheroe v Bond and Wrangle v Brunt both at first instance and on appeal.
