Joshua Jaworski

Joshua is an Associate in Birketts’ Litigation and Dispute Resolution Team, based in Chelmsford. He qualified in September 2020.

Joshua acts for individuals, partnerships and limited companies from various business sectors based in Essex, East Anglia, nationally and internationally in a wide variety of disputes, including breach of contract claims, shareholder disputes (including unfair prejudice petitions, breaches of directors’ duties and derivative claims), complex high-value commercial debt recovery, partnership disputes, disputes arising out of mergers and acquisitions, professional negligence, fraud, defamation, harassment, and enforcement of Judgments in the UK and abroad.

Joshua also has experience of Companies Acts applications to court, such as extensions of time to register charges at Companies House when the time limit has expired, and assisting companies which find themselves without shareholders or directors and in need of “rescue”; please see Josh’s article for further information.

Joshua additionally acts for clients in contentious insolvency situations, including serving or disputing statutory demands for payment, winding up and bankruptcy petitions and applications to set aside or restrain presentation of bankruptcy or winding up petitions. Joshua also acts on other facets of insolvency, such as preference and transactions at an undervalue claims and applications to realise assets for the benefit of creditors.
