The Clubs & Associations Team provide specialist legal advice and support for all types of community amateur sports clubs, including on key issues such as legal structure, governance and membership, and both CASC and charity status.

As a firm with a dedicated and specialist team of charities & not for profit lawyers, we recognise that community amateur sports clubs need advisers who understand their structure, purpose and aims. Critically, it is essential that your advisers recognise the important role that your members play in the governance of your club.

In addition to providing advice on any day-to-day operational, governance or membership queries, we offer specialist services that you will not find at every firm. In particular the Team can assist with the process of incorporating a club that is currently unincorporated, and also supporting registering your club as a CASC with HMRC or as a charity with the Charity Commission.

Our Experience

Birketts advises non-charitable association on incorporation 

Birketts’ Charities Team has advised the Association of Member-Related Pension Schemes on its options regarding incorporation and, subsequently, provided the relevant documentation and legal support to incorporate the association as a company limited by guarantee. The new company’s Articles required certain bespoke provisions to account for both individual and corporate members of the association. 

Birketts advises yacht club on restructuring and CASC registration 

Birketts’ Charities Team advised a yacht club on restructuring from its previous status as an unincorporated association to become a company limited by guarantee with a trading subsidiary so that it would be eligible to apply for CASC status. The Team worked closely with the Birketts’ Corporate Tax team to provide comprehensive advice on tax and regulatory requirements, and successfully achieved CASC status for the club.
