The Team advises on complex option agreements with multiple stakeholders, power purchase agreements, outsourcing and supply agreements, construction and engineering contracts, and planning and environmental issues arising from onshore wind farms, solar panels and battery storage units.

Birketts acts for developers, landowners, funders and investors in renewable energy. The Team advises on a wide range of developments: photovoltaic (ground mount and rooftop), battery, EV infrastructure, wind power, anaerobic digestion, waste powered combined heat and power (CHP) plants as well as newer technologies such as hydrogen.

BESS developer

Advising BESS developer in relation to portfolio of 50MW developments to be connected at transmission level including negotiation of suite of documents with landlord and then agreeing procedure and methodology for roll out across England & Wales and continuing to act on the acquisition of those sites pursuant to the joint venture agreement.

Acquisition of sites

Acting for one of the largest solar developers in the UK on the acquisition of sites (including DCO schemes), providing certificates of title for refinancing and sale of sites acquired and advising on some of the first grid sharing agreements to enable the client to deploy quickly after a sudden change to the subsidy regime.

Assisting with portfolio rollout

Acting for high profile EV chargepoint installer drafting their super charger precedent documentation and assisting with the rollout of their portfolio including designing a shortened DD format to meet costs and time constraints to enable first mover advantage.
