We also work closely with our banking and finance team to advise on debt finance and mortgages for our charity clients. 

Our employment team includes specialists in charity sector employment law issues, including terms and conditions for staff, disability and equality requirements specific to charities, and volunteer management (in particular, advice on how to avoid inadvertently creating an employer/employee relationship). 

A charity’s reputation is often one of its most valuable assets and we provide advice on all aspects of the protection and commercialisation of a charity’s name and brand, including all aspects of intellectual property rights, registration and protection of trademarks and disputes. 

We have specialist expertise advising on commercial contracts for charities, including terms and conditions for the supply of charitable services, outsourcing, IT contracts, and distribution and agency agreements. We also advise on a broad range of fundraising contracts, including sponsorship, working with professional fundraisers and commercial participation. 

Our Exerience

Birketts advises the Castle House Trust (Sir Alfred Munnings Museum) on sale of charity assets 

The Birketts Charities Team has advised the Trustees of the historic arts museum in East Anglia, the Castle House Trust – home of artist Sir Alfred Munnings – on a proposed sale of artworks (those not being part of the core collection) belonging to the museum. The Team assisted the Trustees in applying to the Charity Commission in respect of the proposal, and helped the Trustees to navigate the charity law considerations involved with the sale of the museum’s artworks, including considerations surrounding permanent endowment and trustee duties.
