Helen Stewart

Helen qualified as a Solicitor in February 2007 and joined Birketts in June 2020. She is a Partner in our Commercial Property Team.

Helen’s expertise lies mainly in acting for developers (predominantly residential) and residential land promoters but has wide experience in acting for a variety of landowners including education institutions. General work experience includes dealing with freehold acquisitions/disposals, drafting and negotiating complex documents such as build leases, development management agreements, promotion agreements (including hybrid option agreements), conditional sale contracts, overage and option agreements; advising the residential property team on complex site set up work (which includes acting for housing associations in shared ownership disposals). She has a keen interest in residential property law (having commenced her career as a residential conveyancer) and the area of law around tenants’ rights of first of refusal under the 1987 Landlord and Tenant Act. 

Some of Helen’s most recent experience includes acting for a national housebuilder in connection with the acquisition of a site pursuant to a contract conditional upon planning for up to 600 homes; acting for a local developer in connection with securing land under option for up to 200 homes; acting for a local developer in the acquisition of a development site with a GDV of c£13m which included a conditional contract, overages, option and its subsequent financing; acting for a national housing association to acquire a number of sites nationally for the delivery of affordable homes under s106 from national and regional developers, with package prices of £5m+.
