James is a Senior Associate in our Property Litigation Team.
He has a broad practice, acting for both commercial and private clients in contentious property matters covering areas including real property, landlord and tenant and agricultural land.
James has a particular interest advising clients in the context of real estate investment and development, where he acts for a number of leading real estate investment funds and SIPP / SSAS providers, as well as private investors. He understands the need for commercial, pragmatic advice to support acquisition strategy and enable clients to make informed decisions. Post-acquisition, James is able to offer ongoing support to these clients with a wealth of experience in contentious asset management issues including dilapidations claims, 1954 Act lease renewals, tenant insolvency and tenant breaches of covenant.
In recent years, James has also developed a specialism advising building owners, leaseholders and resident management companies affected by cladding and other fire safety defects in high rise buildings. James has experience advising on the funding of remedial works via the Building Safety Fund and, more recently, the implications of the Building Safety Act for the landlord and tenant relationship and the allocation of liability for fire safety issues.
James is also part of Birketts’ Leasehold Enfranchisement Team, and has experience advising on contested lease extension / enfranchisement claims, right to manage (RTM) claims and rights of first refusal under the Landlord and Tenant Act 1987. James is based in our Norwich office.
Recent work highlights
Acting for the landlord of a large mixed use development on a multimillion pound remediation scheme to resolve fire safety issues, and associated advice relating to implications of the Building Safety Act 2022.
Advising on the applicability of the Landlord & Tenant Act 1987 (rights of first refusal) in relation to the sale of a £40m site in London.
Advising an investment fund landlord in a dispute over the validity of a s.25 notice relating to the tenancy of a high value site in London.
