Ros qualified as a Solicitor at Hertfordshire County Council in January 2002 and joined Birketts in March 2019 following 15 years working for a leading London Planning practice. She is a Legal Director in our Planning and Environmental Team.
Ros is experienced in advising developers, landowners and local authorities on a wide range of planning, highways and compulsory purchase matters. This includes advising clients in relation to the allocation of land through the Development Plan process and providing advice as part of a pre-application review of planning applications including in relation to environmental impact assessments.
Ros has extensive experience of drafting and negotiating section 106 agreements on behalf of developers, landowners and local authorities and in particular in respect of complex, phased projects with long-build out programmes and shared infrastructure costs. She has recently acted for a developer on a garden community scheme which involved the negotiation of side agreements with a neighbouring landowner in respect of the allocation of Housing Infrastructure funding and the facilitating of access across both sites.
Ros also regularly provides advice on the application of the community infrastructure levy (CIL) including taking advantage of the available reliefs and exemptions. She also advises clients in relation to planning appeals and enforcement notice appeals.
Ros also advises clients in relation to both bringing and defending judicial reviews relating to the grant of planning permission. She has experience of judicial reviews both in the High Court and the Court of Appeal and has recently advised an interested party in relation to a judicial review brought against a large retail scheme.
Ros is also experienced in advising on compulsory purchase and development consent orders (DCOs). She has acted for landowners whose property has been impacted by nationally significant infrastructure projects including in relation to the submission of representations to the Examining Authority, attending DCO hearings and negotiating settlement agreements. She has also acted for statutory undertakers whose apparatus is impacted by DCOs including the negotiation of protective provision agreements with the promoter of the DCO.
Ros has also provided compulsory purchase advice to local authorities in relation to the use of compulsory powers to acquire land for regeneration purposes and to protect listed buildings and has also advised landowners in respect of compulsory purchase compensation.
Ros is experienced in advising on all aspects of highways law and in negotiating section 278 and 38 agreements.
Ros is based in our Cambridge office but regularly also works from our Chelmsford office.
