Philippa joined Birketts in September 2011 having qualified in September 2009. She is experienced in regulatory and criminal defence for both corporates and individuals, with a particular emphasis on health and safety, transport regulatory and environmental defence.
She represents those who are investigated by any regulatory body representing companies and individuals across a range of industries in investigations and prosecutions by regulators including HSE, Environment Agency and DVSA as well as Local Authority departments.
Philippa advises companies in relation to health and safety defence and undertakes accident investigations following incidents. Recent health and safety cases include:
- Advising a company in relation to a fatality following an explosion at a chemical plant. Her health and safety practice extends to providing training to companies up to board level.
- Assisting on an accident investigation at a manufacturing plant where an employee’s hand was trapped in machinery resulting in amputation of a finger.
Her regulatory practice extends to representing Operator Licence holders and transport managers at preliminary hearing and public inquiries before the Traffic Commissioner. She also provides training to transport company directors and licence holders on operator licensing.
Philippa’s environmental practice includes defending environmental matters such as cases under the Environmental Permitting Regulations 2010 and the Environmental Protection Act 1990. Recent environmental cases include:
- Successfully persuading a local authority to withdraw the prosecution against her client for an offence of breach of a TPO; on review of the facts of the case she was able to convince the local authority to reduce their enforcement action to a caution with conditions of costs and replanting, a much more favourable outcome for both parties.
- Providing advice to a company and sole director in a prosecution brought by the Environment Agency of five defendants under the Environmental Permitting Regulations 2010. This complicated matter has been subject to a High Court application by the co-defendants and is currently in the Crown Court for Confiscation Proceedings under the Proceeds of Crime Act.
Philippa also prosecutes for both local authorities and private companies in a range of offences, providing advice on prosecution all the way through to advocacy in the Magistrates’ Court. She has led several successful prosecutions on behalf of a national water company for offences under the Water Industry Act 1991. She also acts for local authorities leading prosecutions for offences of illegal waste disposal and breaches of tree preservation orders.
She advises charities and public bodies on regulatory matters.
