Anna joined Birketts in September 2015 and qualified as a Solicitor into the Commercial Litigation Team in our Norwich office in September 2017. She became an Associate in October 2020.
Anna gained experience assisting in a wide range of disputes including will disputes, professional negligence claims, breach of contract claims and debt recovery whilst she was a trainee. As a trainee Anna also spent time in the private client team and is now a member of our specialist, Contentious Trust and Probate Team. Anna deals with disputes concerning the following:
- lack of testamentary capacity;
- undue influence;
- fraudulent calumny;
- proprietary estoppel;
- claims pursuant to the Inheritance (Provision for Family and Dependants) Act 1975;
- lifetime gifts;
- executor and trustee removal claims;
- power of attorneys and deputyships which are dealt with in the Court of Protection; and
- exercise of trustee’s powers including breach of trust.
Anna understands that for the vast majority of cases concerning litigation of this type, it is a very emotional experience for the parties involved and tailors her approach accordingly. Anna is mindful that the parties may wish to retain their relationship after the litigation has concluded and appreciates that often it is best to approach the dispute in a conciliatory manner. However where appropriate Anna is robust and champions her client’s position.
Anna has extensive experience in dealing with alternative dispute resolution options through various mechanisms such as written negotiations and mediation in order to achieve an outcome as efficiently and proportionally as possible. However, if settlement is not possible, Anna has experience with disputes dealt with in the High Court and Court of Protection respectively.#
Anna is also able to advise individuals if they are concerned that their estate may be subject to a challenge in order to take steps to minimise the risk.
Anna is currently completing the Association of Contentious Trust and Probate Specialists training course. Anna also attends various training sessions in order to ensure she is up to date with the evolving case law surrounding this area of law.
Anna was named 'NNLS Trainee Lawyer of the Year' at the Norfolk and Norwich Law Society Awards 2017.
