Jonathan qualified as a Solicitor in the Social Housing Team in 2017 having completed his training contract with Birketts between 2015 and 2017. He became an Associate in October 2020.
Jonathan deals with a variety of social housing matters, including acquiring land and affordable units on behalf of housing associations and local authorities, drafting shared ownership leases and preparing newly developed sites for both open market and affordable unit sales.
Jonathan advises clients on niche areas of charity law and he has a particular interest in planning agreements; in particular their effect and impact on the provision of affordable housing. He has experience in drafting and negotiating tailored Section 106 Agreements (ensuring in particular their compliance with modern mortgagee protection provision standards) and nominations agreements with a number of local authorities and also deals with a variety of infrastructure agreements (e.g. s.104. s.38 and. S278) and wayleave agreements, as well as with post-development matters such as the transfer of open space or disposals to a residents’ management company.
Jonathan has experience in negotiating and drafting management agreements, leases (with management provisions) and service level agreements for housing associations, and is developing a good understanding as to the day-to-day operation of such schemes. For instance, Jonathan has recently been working closely with a regional housing association to draft and negotiate documentation required to provide much needed accommodation for homeless migrant workers.
Jonathan is acutely aware of how changes to the social housing and development sectors can affect individual clients and their regulatory requirements. He recently carried out a full review of a London housing association’s suite of policy documents, amending and re-drafting where necessary to ensure they are fully compliant with modern standards and expectations. He also delivers training sessions to clients on key areas of property law and has prepared a number of articles for Birketts’ website.
Although Jonathan’s work is predominantly tailored towards social housing, he also has a good relationship with a number of local and national housing developers and can use his enhanced knowledge of housing associations to ensure developer clients are able to accommodate their particular requirements which are often above and beyond the average market purchaser. Jonathan is also able to assist developer clients starting with their acquisition of bare land all the way through to the sale of the final market unit.
