Abigail Trencher is a Partner in Birketts Employment team, having joined Birketts in 2008. She leads both the Employment team in Cambridge and Birketts’ firmwide Education team.
Abigail excels in helping organisations navigate complex employee relations issues. She is particularly adept at working with clients in the education and charity sectors, providing guidance on a wide range of employment matters such as contractual issues, discrimination claims, TUPE transfers and large-scale redundancy programs. Abigail also supports private sector clients with board-level disputes, advice on the enforcement of restrictive covenants and organisational change strategies and implementation.
Abigail advises on professional conduct and regulation, leading Birketts’ team of legal advisers who advise regulatory bodies on the law relating to professional discipline and regulation. Her expertise in this area ensures that clients receive comprehensive and informed advice on maintaining high standards of professional conduct. Birketts is one of only three firms appointed to advise the Teaching Regulation Agency’s professional conduct panels.
In recognition of her expertise and commitment to education, Abigail was appointed as a Governor at Anglia Ruskin University in 2017. This role allows her to contribute to the governance and strategic direction of the university, furthering her dedication to the education sector.
Recent work highlights
Advising a large education sector employer on a large scale redundancy exercise, which was completed within the projected time and without any unfair dismissal claims arising.
Acting for an independent school in its successful defence of an unfair dismissal claim.
Successfully defended at the High Court the enforcement of restrictive covenants contained in the contracts of two departing employees moving to a competitor: Pickwell,v Pro Cam CP Limited [2016] EWHC 1304 (QB).
