Whilst Birketts has always had insurance expertise across a number of departments, the dedicated London contentious (re)insurance offering was created as a result of the merger in May 2020 of EC3 Legal (a boutique (re)insurance firm) and Birketts.
The team is known for being ‘part of the market’ rather than just another service provider, for its (re)insurance coverage advice and dispute resolution (both litigation and arbitration).
The team has extensive experience of advising major (re)insurers in the London, Bermudian and International markets on complex coverage issues across most non-marine classes of (re)insurance business, including direct, facultative, proportional and noon-proportional. Much of the work is international in nature, and the team has been heavily involved in many of the major market issues over the last 20 years.
A significant part of the teams work is international in nature, and they have dealt with coverage disputes in excess of 60 jurisdictions, often acting as co-ordinating counsel working with experienced overseas practitioners.
On the non-contentious side, the team is regularly involved in drafting wordings, structuring programmes (in particular for Captives) and global programmes.
The non-contentious team has also worked with both Lloyd’s brokers and non-Lloyd’s brokers, coverholders, MGAs, Lloyd’s syndicates and third party insurance intermediaries and service providers operating in the general insurance market. Advice covers a broad range of matters including corporate/M&A advisory work, governance and FCA insurance regulation, underwriting, claims and run-off arrangements
