Maria is a Partner in our Intellectual Property Team based in the Cambridge office. Maria was admitted as a Solicitor in April 2004 and joined Birketts in June 2015.

Maria specialises and has extensive experience in intellectual property acting for clients in contentious matters involving copyright, trade marks, and design rights, as well as passing off, patent ownership disputes and breach of confidence.   

Maria’s litigation experience relates to a broad range of products from drinks, fragrance, jewellery and fashion to dishes, vessels for liquids, toys and images of products for retail.

Maria regularly represents clients at the High Court, the Intellectual Property Enterprise Court (“IPEC”) and the UKIPO (and formerly the EUIPO).  

As part of her intellectual property practice, Maria provides clients with commercially focussed advice on the options for enforcement including the most appropriate forum based on the intellectual property rights in question and the resources and aims of the client. Maria works closely with colleagues across the Intellectual Property Team to provide a complete and seamless service for clients to go from identification of the intellectual property rights, to appropriate protection and subsequent enforcement.

For our clients based in the technology sector Maria’s experience in commercial disputes is of particular assistance and she has acted for clients in disputes relating to software, software development and IP disputes arising from software and databases. Maria also acts for clients in the growing area of data protection breach claims.

Maria’s practice incorporates advising in relation to domain name disputes and she acts for clients in actions using Domain Name Dispute Resolution services and represents clients in Company Name Tribunal matters.

Maria increasingly acts for clients in relation to social media related disputes in particular with aspects of defamation. 

Maria’s background is in broader commercial litigation in relation to matters such as contractual disputes, shareholder and director disputes and professional negligence claims which she continues to do. This expertise is of particular assistance when acting in these disputes where IP assets are a core feature.  

Many of the cases in which Maria acts involve an international element, for example acting for international clients with UK IP assets to protect, or those in disputes where the chosen jurisdiction is England and Wales.

Maria works with clients from a wide variety of sectors, including food and drink, fashion / jewellery, retail, energy and professional services.

Maria was admitted as a Solicitor in April 2004 and holds a Post Graduate Diploma in Intellectual Property Law. She is fluent in Spanish.
