Resolving Disputes
It is not always possible to balance the needs of the family with the needs of the business and conflicts inevitably arise from time to time. Aside from being an unwelcome drain on business resources, where family businesses are involved, disputes can cause tensions between family members, even extending to those who have no day-to-day involvement in the business.
The likelihood of disputes can be minimised by the creation of a family constitution which will set out clearly the various needs and roles of family members, whether they are actively involved in the business or not. It is imperative that issues which have the potential to escalate into disputes are identified and resolved at an early stage. We have a strong ethos of achieving commercially sound outcomes, ensuring minimum disruption to your business or family relationships. We will often advise deploying alternative means of dispute resolution and have mediators qualified to deal with commercial, employment and family disputes.
