Abbie joined Birketts in March 2019. She is a Paralegal in our Employment Team and is a future Trainee Solicitor at Birketts commencing her training contract in 2022.
Prior to joining Birketts Abbie graduated with a 2:1 in her law degree from City, University of London in July 2018. She has experience working in various law firms during her degree, working pro bono in a Legal Advice Centre and working as a legal intern in-house with Group Legal Counsel at a yacht distribution company in London.
In June 2020, she completed her Legal Practice Course (LPC LLM) at the University of Law in Moorgate with a Distinction, whilst working at Birketts full-time. She chose to carry out electives in Employment Law, Commercial Law, Advanced Real Estate and Family Law. She completed her LLM in Employment Law, focusing on the topic of Employment Status, a complex area of law predominantly governed by case law and recently considered by the Supreme Court in Uber BV and others (Appellants) v Aslam and others (Respondents)  UKSC 5.
Employment Tribunal Claims
Abbie works side by side with the lawyers that form our Employment Team providing assistance on a broad range of contentious and non-contentious matters. She is primarily responsible for preparing all documentation relating to Employment Tribunal claims, including drafting responses to claims, ensuring compliance with case management deadlines, preparing bundles and drafting witness statements. Abbie instructs counsel to represent our client at the hearing, liaises with counsel on behalf of our client to ensure the case runs smoothly and then attends the Employment Tribunal hearing to ensure our client is comfortable and understands the process. She places a strong emphasis on supporting our clients from start to finish of an Employment Tribunal process.
Abbie’s experience ranges from simple unfair dismissal claims to complex discrimination and equal pay claims, acting for both claimants (employees) and respondents (employers).
Settlement Agreements and ACAS COT3s – Settling Disputes
Abbie frequently drafts both COT3 and settlement agreements, providing transparent advice to clients to settle Employment Tribunal claims for a variety of simple and complex claims or to settle dispute that have arisen prior to the Tribunal process.
Abbie guides clients by providing a pragmatic and commercial view of Employment Tribunal claims, taking into account the merits of the claim and of course the views of the Client, to deliver a positive and favourable outcome. She liaises with ACAS or representatives on any client’s behalf to ensure that agreement is reached as soon as possible
Employment Contract and Handbook Reviews
Abbie is experienced in drafting and reviewing both junior and senior employment contracts, as well as director service agreements. She also provides tailored reviews of staff handbooks and/or drafts bespoke policies and clauses to ensure these documents are legally compliant and suitable for our client’s business. She offers personalised advice on supplementary policies to ensure that our clients have all mandatory and recommended policies for the needs of their sector. Namely, Abbie has particular experience advising the education, tech, automotive and retail sectors.
Covid-19: Furlough and Beyond
More recently, Abbie has assisted her colleagues with advice relating to the furlough scheme and redundancies. Advice surrounding this area continues to be seen in Employment Tribunal claims and many businesses continuing to consider redundancies for the needs of their businesses.
